The procedures for selecting and dismissing magistrates are
discussed and it is argued that the system results in an
unrepresentative bench with considerable regional variations
in, for example, the granting of bail. Magistrates
frequently appear to flout procedures in a desire to help the
police and, it is suggested, sometimes forget that a basic
level of English law is the presumption of innocence
