Spain: Trial by jury comes of age

During September 10,000 people will be selected to take part in the first jury trials in the post-Franco Spanish state. They will deal with over one thousand criminal trials during 1996. The jury, which will consist of nine people, will reach a decision on a majority basis; seven votes for a guilty decision and five for an acquittal. All jurors will be required to vote. The jury is not unknown in the Spanish juridical tradition and has been used before during periods of democracy. The concept goes back to 1820 and was applied continuously for thirty five years during the period from 1888 to 1923.
