Solicitor sues West Midlands police

Gerald Davies, a solicitor in Birmingham, is to sue the
Chief Constable of West Midlands police, seeking exemplary
damages, after he was arrested in Sutton Coldfield
magistrates' court and held in a cell at Sutton Coldfield
police station for more than an hour.
On 20 December Mr. Davies was acting as a defence
lawyer in a minor dishonesty case. Whilst the magistrate was
out of the room, Mr. Davies, as a matter of courtesy, showed
a relevant document to the prosecution solicitor who asked
if a police constable could see the document. This was
allowed but the police constable then asked for the
document. When Mr. Davies said that although he thought
there would be no objection to this, the request for the
document would have to come from his superior officers as it
could become an exhibit in the case, the police constable
promptly arrested him on the ground that he had obstructed a
police officer in the execution of his duty. (Independent
