EU: Terrorist content online: revised text of the proposed Regulation following discussions in the Terrorism Working Party


On 19 October the Presidency of the Council issued the first revised version of the proposed Regulation on preventing the dissemination of terrorist content online, following discussions in the Terrorism Working Party and the submission of written comments by Member States' delegations.

"At the meetings and in their subsequent written comments, the Member States requested further clarification on a number of issues. Some of these issues have been addressed by introducing further explanatory text in the recitals. Recitals (7) and (9) contain additional wording on the freedom of the press and the media. Furthermore, the Presidency has made an attempt to specify the scope of the Regulation in the definitions' Article (Article 2), where amendments have been introduced to better align the definition of "terrorist content" with the definition contained in the Directive to combat terrorism1. On "Removal orders", text has been added to recital (13), and a new recital (13a) has been introduced. On "Proactive measures" (Article 6), the question of "prior censorship" has been addressed by amending paragraphs 2 and 4., including "coercive measures", where text has been added both to the Article and the corresponding recital (34).

Taking into account the comments, the Presidency is well aware that further discussions will be needed on a number of topics, in particular "Jurisdiction" (Article 15) and "Penalties" (Article 18).

6. Concerning Article 13 on "Cooperation between competent authorities, union bodies and hosting service providers", please note that Europol will be present at the meeting of 25 October 2018, in particular to respond to questions of a technical nature, which you might have."
