The ECBA criticises the proposal and the draft European Parliament report:

"We have many concerns about the Directive on the freezing and confiscation of proceeds of crime in the European Union (COM(2012)0085 – C7-0075/2012 – 2012/0036(COD)) (the “Commission’s Proposal”) and the Draft Report of MEP Macovei of 28 August 2012...The draft Directive introduces non-conviction based confiscation and third-party confiscation."
