The Commission has put forward a Communication and draft Regulation on EU border controls - internal and external - which will "consolidate all existing laws including the Schengen "acquis" on this issue. It is intended to "compliment" the planned EU Border Management Agency. The proposal says that "people may cross borders at all times without being checked" except where member states invoke threats to public order, public health or internal security. It is based on Article 62 of the EC Treaty: Communication and proposed Council Regulation establishing a Community Code on the rules governing the movement of persons across borders (pdf, 832 MB)
