(Case C-428/08, pdf).

Having chosen not to participate in the common EU visa policy and the development of VIS, the UK was also excluded from the decision to grant Europol and law enforcement agencies in the member states access to VIS data. The British government is now seeking annulment of the latter decision (i.e. access to VIS for UK law enforcement agencies) on the grounds that the EU decision was given an incorrect legal basis in the provisions developing the Schengen area.
