Entry into force 29 Dec. 1998 in first 15 Member States; the twelve new Member States have ratified: Protocol
Status to be replaced by Decision as from 1 Jan. 2010 (See Statewatch Legislative Observatory)
Member States' positions Fourteen of the first fifteen Member States (all except UK) have given jurisdiction to the Court; eleven of them give jurisdiction to all national courts or tribunals to send references (Ireland, France and Spain allow only final courts to refer); six of the new Member States have given jurisdiction to the Court (Hungary, Lithuania, Czech Republic, Estonia and Slovenia allow all courts and tribunals to refer; Latvia allows final courts to refer)
