Greece: A criminal complaint was filed regarding the death of a 31-year-old Iranian national at the Pre-Removal Detention Centre of Moria

February 6, 2020, Mytilene, Lesvos – on 29th January a criminal complaint was filed before the public prosecutor of the first instance court of Mytilene by five NGO attorneys, offering free legal aid to the asylum seekers in Lesvos, with the request to investigate the precise reasons and conditions of the death of the 31-year-old Iranian man, who, according to the report of the online journal “StoNisi”, dated 06/01/2020, was found hanged in the pre-removal detention center of Moria in the morning of that day.

The criminal complaint raises the issue of the insufficient medical and psychosocial services in the Pre-Removal Detention Center of Moria. Specifically, the sole provider of medical services at the Pre-Removal Detention Center, AEMY S.A., employs only one psychologist since April 2019, while there is no interpreter for any language for over a year. As far as the incident at hand is concerned, from the day after the transfer of the Iranian man to the Pre-Removal Detention Center (18/12/2019) until at least 31/12/2019 the only member of the sole provider of medical and psychosocial services in the Pre-Removal Detention Center was on annual leave, without AEMY S.A. having taken care of her replacement. Consequently, almost 85 detainees of P.R.D.C. of Moria were left without any access to the medical and psychosocial services.

The decision to file the criminal complaint was taken after more than 20 days had passed without any relevant announcement by the Greek Police on the investigation of the case and taking into account the long history of previous deaths in Moria. In the cases of the incidents of the tragic deaths in January 2017, when within 1 week 3 people lost their lives because of fumes in frozen tents in Moria, the death of a 24-year-old man from Cameroon in January 2019, and the death of the 49-year-old woman from Afghanistan due to fire in September 2019, no immediate investigations took place nor official announcements were issued regarding the development of the procedures and the relevant findings.

The signatory attorneys, taking into account the fact that the tragic event took place in the area of responsibility of the Greek authorities, ask the public prosecutor to proceed with prompt investigation, in order to establish  the precise reasons and conditions of the 31-year-old Iranian’s death, within the scope of the positive obligations of the Greek state under the article 2 of the European Convention on Human Rights and for any potential criminal acts, including the criminal offense of exposure, according to Article 360 of the Greek Penal Code. Κατατέθηκε Μηνυτήρια Αναφορά για τον Θάνατο του 31χρονου Ιρανού υπηκόου στο ΠΡΟ.ΚΕ.Κ.Α. Μόριας

6 Φεβρουαρίου 2020, Μυτιλήνη, Λέσβος –  στις 29 Ιανουαρίου κατατέθηκε μηνυτήρια αναφορά στον εισαγγελέα πρωτοδικών Μυτιλήνης,  από  πέντε δικηγόρους Μη Kυβερνητικών Oργανώσεων που δραστηριοποιούνται στον τομέα παροχής δωρεάν νομικής βοήθειας στους αιτούντες άσυλο στη Λέσβο, με αίτημα τη διερεύνηση των ακριβών αιτιών και συνθηκών  θανάτου του 31χρονου Ιρανού υπηκόου, ο οποίος, σύμφωνα με το από 6.1.2020 δημοσίευμα του ιστοτόπου «Στο Νησί»,  βρέθηκε απαγχονισμένος σε χώρο του ΠΡΟ.ΚΕ.Κ.Α. Μόριας το πρωί της ίδιας ημέρας.

Η μηνυτήρια αναφορά θέτει υπόψη του αρμόδιου εισαγγελέα το θέμα των ανεπαρκών ιατρικών και ψυχοκοινωνικών υπηρεσιών στο ΠΡΟ.ΚΕ.Κ.Α. Μόριας. Συγκεκριμένα, η αποκλειστική πάροχος ιατρικών υπηρεσιών στον χώρο του ΠΡΟ.ΚΕ.Κ.Α., η ΑΕΜΥ Α.Ε. από τον Απρίλιο του 2019 λειτουργεί μόνο με μια ψυχολόγο, ενώ δεν διαθέτει διερμηνέα για καμία γλώσσα για πάνω από ένα χρόνο. Όσον αφορά την περίπτωση του εν λόγω συμβάντος, από την επομένη της μεταφοράς του θανόντος Ιρανού υπηκόου στον χώρο του ΠΡΟ.ΚΕ.Κ.Α. (18.12.2019) μέχρι τουλάχιστον και τη 31.12.2019 το μοναδικό μέλος του προσωπικού του αποκλειστικού φορέα παροχής ιατρικών και ψυχοκοινωνικών υπηρεσιών στον χώρο του ΠΡΟ.ΚΕ.Κ.Α, ήταν σε άδεια, χωρίς να υπάρξει μέριμνα για την αντικατάστασή της. Έτσι, οι περίπου 85 κρατούμενοι είχαν αφεθεί χωρίς πρόσβαση σε ιατρικές και ψυχοκοινωνικές υπηρεσίες.

Η μηνυτήρια αναφορά κατατέθηκε, καθώς είχαν περάσει είκοσι ημέρες χωρίς η Ελληνική Αστυνομία να προβεί σε ενημέρωση σχετικά με τις ενέργειες διερεύνησης της υπόθεσης, αλλά και λαμβάνοντας υπόψη το μακρύ ιστορικό των θανάτων στην Μόρια. Στις περιπτώσεις των τραγικών θανάτων του Ιανουαρίου του 2017, όπου σε διάστημα μόλις μιας εβδομάδας τρεις άνθρωποι είχαν χάσει τη ζωή τους από αναθυμιάσεις στις παγωμένες σκηνές της Μόριας,  του θανάτου του 24χρονου από το Καμερούν τον Ιανουάριο του 2019, αλλά και στην περίπτωση του θανάτου της 49χρονης Αφγανής μητέρας λόγω πυρκαγιάς τον Σεπτέμβρη του 2019, δεν υπήρξε κατά τα φαινόμενα άμεση και έγκαιρη διερεύνηση των υποθέσεων, αλλά ούτε και επίσημη ενημέρωση σχετικά με την εξέλιξη των διαδικασιών και τα σχετικά πορίσματα.

Οι υπογράφοντες δικηγόροι, λαμβάνοντας υπόψη το γεγονός ότι το τραγικό συμβάν έλαβε χώρα σε χώρο ευθύνης των ελληνικών αρχών, καλούν την εισαγγελέα να προβεί στις απαραίτητες ενέργειες προκειμένου να διερευνηθούν τα ακριβή αίτια και οι συνθήκες θανάτου του 31χρονου Ιρανού υπηκόου, υπό το φως των θετικών υποχρεώσεων της ελληνικής Πολιτείας με βάση το άρθρο 2 της Ευρωπαϊκής Σύμβασης Δικαιωμάτων του Ανθρώπου καθώς και πιθανή τέλεση αξιόποινων πράξεων, συμπεριλαμβανομένου του αδικήματος της έκθεσης κατ’άρθρον ΠΚ 360.
