He however underlines that notice-and-action procedures must respect fundamental rights, including the rights to data protection and to privacy which are notably protected under Articles 7 and 8 of the Charter of Fundamental Rights of the EU, in Article 16 of the Treaty on the Functioning of the EU, and in Directive 95/46/EC and Directive 2002/58/EC.”
