Entry into force after all of the first 15 Member States ratify; entered into force 25 Dec. 2005 after Belgium ratified on 26 Sept. 2005; all new Member States joining in 2004 except Malta have also ratified: Protocol
Member States' positions Fourteen of the ‘old’ Member States to ratify the Protocol (all except UK) have given jurisdiction to the Court; ten eleven of them give jurisdiction to all national courts or tribunals to send references (Ireland, Portugal, and Spain allow only final courts to refer); seven of the new Member States have given jurisdiction to the Court (Hungary, Estonia, Czech Republic and Lithuania allow all courts and tribunals to refer; Latvia, Slovakia and Slovenia allow final courts to refer)
