Treaty provisions on JHA

EU Justice and Home Affairs policy is currently governed by provisions in the TEU and TEC as amended by the 1997 Amsterdam Treaty and 2001 Nice Treaty. The Amsterdam Treaty also incorporated the Schengen framework into the EC/EU legal order

Title IV of the TEC: visas, asylum, immigration and free movement of persons
Title VI of the TEU: police, customs and judicial cooperation in criminal matters
The Schengen Protocol: incorporated the Schengen acquis into the TEC & TEU
Treaty of Nice: includes provisions on JHA and non-military crisis management

The 'Lisbon/Reform Treaty'

The Justice and Home Affairs provisions will be amended if the 2007 'Reform Treaty' is ratified by all member states.
