On 28 July, the Home Secretary, Theresa May, said that it is
"time
to move beyond the ASBO". New government statistics
revealed that the number of ASBOs being issued continues to fall
and that 55% of recipients have breached their order. If an ASBO
is breached, it is breached an average of 4.2 times. May argued
that, rather than the solution, Labour's centralised "top-down,
bureaucratic, gimmick-laden approach" to inherently local
issues became part of the problem. She called for a "complete
change in emphasis, with communities working with the police
and other agencies to stop bad behaviour escalating that far".
However, no details have yet been given as to what this will
entail and for now the ASBO regime remains in place. Media coverage

Two essays written for the launch of the European Civil Liberties
Network (ECLN) cover the use of ASBOs. "The State of Asbo
Britain - the rise of intolerance" by Max Rowlands offers
an overview of their use in the UK, while "The denial of
children's rights and liberties in the UK and the North of Ireland"
by Phil Scraton (professor of criminology at Queens University,
Belfast) deals extensively with their use against children. Both
can be found on the ECLN
website.

Asbo Concern has announced the launch of its first local
campaign group to be based in Manchester, a city whose council
fervently supports ASBOs and has handed them out in record numbers.
The launch meeting takes place on 12 September at 7pm in the
Cross Street Chapel. Further contact details and a list of speakers
are available on their website.

A judge has ruled it "wrong
in principle" to use Asbos as a mechanism for imposing
a longer sentence than the law allows. Mr Justice Hughes,
ruling in the case of a motorist who had breached his order by
driving whilst disqualified, argued that while the maximum
punishment may be set low, it was a decision for Parliament,
not the Courts. Asbos are increasingly being used to deal with
behaviour that is already covered by criminal law, in part because convictions
are both easier to achieve and punishable by longer prison sentences.

A 15-year-old boy who claimed that
child curfew zones, as established under the Anti-social Behaviour
Act, amounted to a breach of human rights has
won his case at the High Court. Under the terms of the
Act, any child found to be within one of the 400+ areas that
have been designated as dispersal zones between 9pm-6am can be
taken home by the police regardless of whether they are suspected
of any wrong doing. Liberty, who supported the boy's case, have
